MOTOR VEHICLES AND TRAFFIC
ARTICLE I
INOPERABLE MOTOR VEHICLES
SECTION 13-1: DEFINITIONS
The term “inoperable motor vehicle” as used in this Article shall mean any motor vehicle from which, for a period of at least seven (7) days, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own power. The term “inoperable motor vehicle” shall also mean any motor vehicle which, for a period of at least seven (7) days, has remained on a lot or parcel of property and is not currently registered with a duly authorized Illinois or other state’s or nation’s department of motor vehicles, transportation, secretary of state, registration or other applicable agency or department. The term “inoperable motor vehicle” shall not include a motor vehicle which has been rendered temporarily, for a period not exceeding seven (7) days, incapable of being driven under its own power in order to perform ordinary service or repair operations. SECTION 13-2: PUBLIC NUISANCE DECLARED
It is hereby declared that all inoperable motor vehicles, whether on public or private property and in view of the general public, are a public nuisance. Any motor vehicle or part thereof which is inoperable or deteriorated or in need of repair which is located for seven (7) days or more upon public or private property within the Village of Lena, Illinois outside any enclosure which encloses the vehicle completely from lateral view on all sides, is hereby declared to be a public nuisance.
SECTION 13-3: REPAIRS/TIME LIMIT
Any inoperable motor vehicle which has been rendered temporarily, for a period of seven (7) days or more, incapable of being driven under its own power in order to perform ordinary service or repair operations is hereby declared to be public nuisance. Said inoperative motor vehicle which has been rendered temporarily, for a period of seven (7) days or more, incapable of being driven under its own power in order to perform ordinary service or repair operations shall be placed within a building, which building encloses the vehicle completely from lateral view on all sides so that it is not in view of the general public.
SECTION 13-4: EXCEPTION
Nothing in this Article shall apply to any motor vehicle that is kept within a building or an enclosure which encloses the vehicle on the lawfully zoned premises of a place of business engaged in the repair, wrecking or junking of motor vehicles.
SECTION 13-5: PENALTY
Any owner or lessee, or any other person in control of the premises and the owner or lessee regarding any public nuisance as declared in this Article found in violation shall be fined $100.00 – $500.00.
Each day a continuing violation exists may be deemed a separate offense.

SECTION 13-6: ENFORCEMENT
This Article shall be enforced by the Village President or the Village Police Department as may from time to time be designated to enforce this Article by the Village of Lena.
SECTION 13-7: REMOVAL, AFTER NOTICE
(A) The Village Police Department is hereby authorized to remove, after seven (7) days from the issuance of the municipal notice, any inoperable motor vehicle or parts thereof.
(B) Prior to removing any inoperable motor vehicle or parts thereof, said law enforcement agency shall send a municipal notice to the owner or occupier of the public or private property involved where said offending inoperable motor vehicle or parts thereof are located, stating in substance, that said inoperable motor vehicle, or parts thereof, after reasonable notice describing the same in said notice, are to be removed by said owner or occupier of the public or private property involved within seven (7) days after the date of service of said notice. Said municipal notice may be served by deposit in the U.S. Mail with sufficient postage for delivery of same, or be personal service of said notice by said law enforcement agency of the Village, or by deposit in the U.S. Mail by certified mail, return receipt requested or registered mail with the proper postage prepaid addressed to said owner or occupier of the premises involved.
(C) After seven (7) days from the issuance of said municipal notice, said inoperable motor vehicle or parts thereof which have not been removed shall be removed by said law enforcement agency of the Village to a suitable storage area. The owner or occupier of the land involved or the owner of said inoperable motor vehicle or the part thereof, shall be liable for the payment of reasonable charges for towing and storage of such inoperable motor vehicle or parts thereof as a condition to regaining possession.

ARTICLE II
ILLINOIS VEHICLE CODE
SECTION 13-21: ADOPTION
The Illinois Vehicle Code as now or hereafter amended [625 ILCS 5/1-100 et seq.] is adopted by reference as if set forth at length in this chapter.
SECTION 13-22: TERMS
Terms used in this chapter that are defined in the Illinois Vehicle Code have the meanings assigned to them by such code.
SECTION 13-23: VIOLATIONS
Any person who violates any of the provisions of the Illinois Vehicle Code shall be punished as provided in same.
SECTION 13-24: CONFLICTS

In the event of a conflict between the provisions of this chapter and the Illinois Vehicle Code, the provisions of this chapter shall control.

ARTICLE IV
TRAFFIC SIGNS, SIGNALS, AND MARKINGS
SECTION 13-48: AUTHORITY FOR TRAFFIC SIGNALS
The Village of Lena through its designated officers, employees or contractors may designate streets and alleys, and place and maintain traffic control devices upon said streets and alleys within the Village and subject to the jurisdiction of the Village, including but not limited to stop and yield signs for the designation of any intersection as a stop or yield intersection. All traffic control devices shall conform to the current edition of the Manual on Traffic Control Devices for Streets and Highways as published by the U. S. Department of Transportation and as adopted by the State of Illinois.

ARTICLE V
SPEED RESTRICTIONS
SECTION 13-63: SPEED LIMITS
Except as otherwise provided in this Ordinance, it shall be unlawful for any person to drive any motor vehicle on any street not under the jurisdiction of the state or the county in an urban district within the Village at a speed in excess of twenty-five (25) miles per hour, unless otherwise posted.

ARTICLE VI
SNOW REMOVAL – EMERGENCIES
SECTION 13-68: SNOW EMERGENCY
(A) There is hereby declared an emergency within the Village of Lena at any time snow shall accumulate to a depth of two (2) inches and shall continue until the snow has been plowed and removed from the streets within the Village.
SECTION 13-69: LIMITED PARKING
(A) It shall be unlawful to park any vehicle within the following described areas when there is an accumulation of snow of two inches or more on the ground:

(B) All vehicles must be parked on the odd numbered side of the street on odd numbered days of the month and on the even numbered side of the street on even numbered days of the month from November 1 to April 30, when there is an accumulation of snow of two inches or more on the ground. Vehicles parked in the lot on Main Street must park at the fence side closest to the railroad tracks.
(C) All vehicles must be parked on the proper side of the street in conjunction with the day of the month after 1:30 a.m. on that day.
(D) Any person who violates this schedule shall be subject to a fine of $75 for each violation. The Village shall also be entitled to reasonable attorneys fees and costs for any violation adjudicated in a legal forum. Police officers shall have the discretion to issue a warning ticket for a first-time violation. However, citations shall be mandatory for all subsequent

violations. The Village or its agents shall have the right to remove any illegally parked vehicle at the owner’s expense.
Section 13-70: OVERNIGHT PARKING IN THE DOWNTOWN DISTRICT
(A) It shall be unlawful to park any vehicle within the following described areas overnight:

(B) Any person who violates this schedule shall be subject to a fine of $75 for each violation. The Village shall also be entitled to reasonable attorney’s fees and costs for any violation adjudicated in a legal forum. Police officers shall have the discretion to issue a warning ticket for a first-time violation. However, citations shall be mandatory for all subsequent violations. The Village or its agents shall have the right to remove any illegally parked vehicle at the owner’s expense.

ARTICLE VII
STANDING, STOPPING AND PARKING
SECTION 13-91: NO PARKING ZONES; LIMITED PARKING
(A) The parts of streets in the Village designated by the Board of Trustees, and posted as such, shall be no parking zones, and no vehicle shall be parked in such no parking zone at any time as posted except where an indented curb allows parking space entirely between the established curb line and the sidewalk. The Village Board may also from time to time establish streets and parts of streets as no parking zones between the hours of 2:00 a.m. and 6:00 a.m., and when signs prohibiting parking between such hours are posted on such streets and parts of streets, no vehicles shall be parked in such streets and parts of streets, between such hours, except where an indented curb allows parking space entirely between the established curb line and the sidewalk.
(B) The parts of streets in the Village designated to be limited parking zones by the Board of Trustees, and posted as such, shall be limited parking zones, and no vehicle shall be

parked in any such limited parking zone for a longer time than designated, on any day except Sundays and holidays, than the period of time respectively designated for each such limited parking zone, except where an indented curb allows parking space entirely between the established curb line and the sidewalk.
(C) The Village of Lena Board of Trustees has designated there will be no overnight semi-tractor/trailer parking in the downtown parking lots on Main and Railroad Street. (Passed 06/12/17)
(D) The fine for any violation of this Article, except as otherwise provided herein, shall be $5.00 for each occurrence. The fine for illegally parking in a handicapped parking space shall be $50.00, and the fine for fire hydrant, snow plowing and street sweeping violations shall be $25.00.
SECTION 13-92: PROHIBITED PLACES OF PARKING
(A) On the roadway side of any vehicle stopped or parked at the edge or curb of a roadway.
(B) On a sidewalk.
(C) Within three feet of the nearest edge of a public or private driveway or opposite such driveway so as to obstruct ingress or egress.
(D) Within an intersection.
(E) Within fifteen feet of a fire hydrant.
(F) On a crosswalk.
(G) Within twenty feet of a crosswalk.
(H) Within thirty feet of any flashing signal, stop sign, yield sign, or traffic control signal located at the side of the roadway.
(I) Upon any bridge or other elevated structure.
(J) In any areas where no curbing is provided, it shall be unlawful to stop, stand or park any portion of a vehicle on the side of said roadway with any portion of the vehicle protruding on the paved or designated area for the roadway.
(K) Automobiles, trucks and other vehicles shall be prohibited from parking along either side of Schuyler Street marked Illinois Route 73, from Railroad Street to Grove Street, and along either side of Lena Street (CH6/FAS65) from a point 350 lineal feet northwest of the Illinois Route 73 southbound through traffic lane edge of pavement extending southeast to Washington Street in the Village of Lena. Parking will not be permitted within the limits of intersections as determined by the State from Intersection studies. (Passed 04/12/04)
SECTION 13-93: No person shall, without the permission of the owner or lessee of any private property, leave or park any vehicle thereon if there is plain view on such property a “no parking” sign or a “parking this side only” sign.
SECTION 13-94: Every vehicle stopped or parked upon a two way or one way roadway shall be so stopped or parked with its right hand wheels parallel to and within twelve inches of the right hand curb or as close as practicable to the right edge of the right hand shoulder.

SECTION 13-95: Any person violating or disobeying any parking sign shall be issued a citation, which may result in a fine. If said citation is paid within ten days from the issuance of said citation, the fine shall be five dollars ($5.00). If said citation is not paid within ten days from the issuance of the same, the fine shall be ten dollars ($10.00). A separate offense shall be deemed committed upon each day during or on which violation occurs or continues.
SECTION 13-96: PARKING AND OPERATION OF COMMERCIAL VEHICLES IN RESIDENTIAL AREAS
(A) A “Commercial Vehicle” for purposes of this section shall be defined as a truck or other vehicle in excess of 2-ton capacity used primarily for transportation of property or for other commercial use, and passenger vans in excess of 1-ton capacity.
(B) Parking of Commercial Vehicles on any street in a residentially zoned district for more than two hours in any 24-hour period is prohibited. Provided, however, that a Commercial Vehicle may be parked on a street in a residential zoned district for more than two hours in a 24 hour period, while being loaded or unloaded, or while the custodian of the vehicle is performing services for hire in or about a residence or site abutting the street on which the vehicle is parked.
(C) The operator of a Commercial Vehicle shall not allow the engine to idle for more than 10 minutes in any 6-hour period in a residentially zoned area.
SECTION 13-97: PARKING OF TRAILERS, CAMPERS, ETC
No trailers, campers or any other equipment designed to be pulled behind another vehicle shall be parked upon any street in the Village for a period of time in excess of 2 hours, unless being loaded or unloaded, or while the owner or custodian of the equipment is performing services for hire in or about a residence or site abutting the street on which the equipment is parked.
SECTION 13-98: WEIGHT OF VEHICLES LIMITED BECAUSE OF DETERIORATION DUE TO CLIMATIC CONDITIONS; SIGNS
(A) Whenever by reason of deterioration, rain, snow, freezing and thawing, or other climatic conditions, highways under the control, supervision and jurisdiction of the Village of Lena may be damaged or destroyed, the maximum weights permitted to be transmitted to the surface of any vehicle shall be limited to conform with the following limitations:

*Gross axle load 11,000 lbs.
The above limitation shall be in effect for a period not to exceed ninety (90) days in any one calendar year, and a notice of the above prohibitions and restrictions shall be posted at each end of that portion of any such highway on signs with black printing on a white background and minimum measurements of thirteen inches by nine inches (13″ X 9″).

(B) The Village President is hereby authorized and directed to cause signs to be erected and maintained at each end of any such highway, which signs shall designate the maximum weight restrictions here adopted and shall read as follows:

SECTION 13-99: PENALTIES
Whenever any vehicle is operated in violation of Section 13-98 of this Chapter, the owner or driver of such vehicle shall be deemed guilty of such violation and either the owner or the driver of such vehicle may be prosecuted for such violation. Any person, firm or corporation convicted of any violation of Section 13-98 hereof shall be fined according to the following schedule:

SECTION 13-111: TRUCK AND COMMERCIAL VEHICLE TRAVEL UPON ROADWAYS

(A) The operation of trucks or other commercial bearing an Illinois Class “J” license plate or above is hereby permitted upon the following roadways/highways only, which are hereby designated as “Truck Routes”:
1) Lena Street
2) Schuyler Street
3) North Main Street between West Main Road and Stagecoach Road/West Galena Road/West Lena Street (near St. Joseph Cemetery)
4) West Main Road west of North Main Street
5) East Railroad Street between North Schuyler Street and North Dayton
Street
6) North Dayton Street between East Railroad Street and East Lena Street 7) East Main Street (300 yards northwest of East Town Line Road)
8) East Town Line Road (500 yards west of Galena Road/Lena Street)
9) Evergreen Drive
10) Dodds Drive between South Logan St. (HWY 73) and Evergreen Drive
11) Division Street between West Railroad Street and West Lena Street
12) Fremont Street between East Lena Street and West Range Road
13) East Townline Road between West Galena Road and South Logan Street
The operation of trucks or other commercial vehicles bearing an Illinois license plate of Class “J” or above is hereby prohibited on any other Village roadway not
designated as a “Truck Route” immediately above.
The Village’s Corporate Authorities may add to, remove, or otherwise modify the approved “Truck Routes” set forth above via the passage of a resolution.
(B) This chapter shall not apply to businesses, which are located upon said roadways/highways, where such travel is for the limited purpose of traveling to and from their “home base”. This chapter shall not apply to garbage trucks, school buses, municipal vehicles and emergency vehicles.
(C) A “truck” is defined as every motor vehicle designed, used, or maintained primarily for the transportation of property.
(D) A “commercial vehicle” is defined as any vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, for-hire or not for-hire, but not including a commuter van, a vehicle used in a ride-sharing agreement when being used for that purpose, or a recreational vehicle not being used commercially.
(E) Any person found in violation of this section will be fined $100.00 – $500.00. SECTION 13-111.1: USE OF DYNAMIC BRAKING SERVICES PROHIBITED
(A) A dynamic braking device (commonly referred to as “jake brakes” “Jacob brakes” “engine brakes” or “compression brakes”) means device, primarily on trucks, that converts the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.
(B) No person shall operate any motor vehicle with a dynamic braking device engaged within the municipal boundaries of the Village of Lena except for emergency situations for the purpose of avoiding a collision with another object or vehicle.

(C) Penalty. Any person who violates the provisions of this Section shall be, upon conviction, punished by a fine of not less than $75.00 nor more than $200.00. (Passed 10/30/06)

UTV/GOLF CARTS

SECTION 13-113: RULES AND REGULATIONS
UTV’s and Golf Carts may only be operated on the Village streets in accordance with the following rules and regulations:
(A) Any person who operates a UTV or Golf Cart in the Village of Lena will take full responsibility for all liability associated with its operation.
(B) Any person who operates a UTV or Golf Cart must be at least eighteen (18) years of age and possess a valid driver’s license to operate a motor vehicle issued by the State of Illinois or another State.
(C) No person shall operate, and no owner shall permit another person to operate a UTV or Golf Cart on a Village street unless: 1) the UTV or Golf Cart is covered by a liability insurance policy as required by Section 7-601 of the Illinois Vehicle Code (625 ILCS 5/7-601); and 2) the operator of the UTV or Golf Cart carries with him proof of liability insurance as required by Section 7-602 of the Illinois Vehicle Code (625 ILCS 57-602).
(D) UTV’s or Golf Carts shall only be allowed to be operated on Village streets between one-half hour before sunrise and one-half hour after sunset, as established by the National Weather Service. UTV’s or Golf Carts may be operated at any time of the day or night if equipped with a yellow flashing light visible for at least 100’ from the rear of the vehicle.
(E) No person shall operate a UTV or Golf Cart on a Village street in excess of the posted speed limits.
(F) UTV’s or Golf Carts may not be operated on State Highway 73, Stagecoach Trail/Lena Street, and Lake Road except to cross said highway at intersections, in a path 90 degrees or as direct as possible across said highway, to the nearest intersecting street.
(G) UTV’s or Golf Carts shall have their headlights and taillights on at all times when operated on Village streets.
(H) UTV’s or Golf Carts may not be operated when visibility is impaired by weather, smoke, fog, or other conditions or at any time when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet.
(I) UTV’s or Golf Carts may not be operated on the sidewalks.
(J) UTV’s or Golf Cart drivers must yield the right-of-way to overtaking vehicles at all times.

(K) Any person who operates a UTV or Golf Cart on the streets of the Village of Lena must adhere to all applicable state laws concerning the possession and use of alcoholic beverages and all illegal drugs, as well as all other State traffic laws.
(L) The maximum occupancy of UTV’s or Golf Carts traveling on Village streets shall be equal to the amount of safety belts or passenger restraints on the UTV or Golf Cart.
(M) Each driver and passenger of a UTV or Golf Cart shall wear a properly fastened and adjusted seat safety belt. Children must be secured in a child restraint system as required pursuant to the Child Passenger Protection Act (625 ILCS 25/1 et seq).
(N) UTV’s or Golf Carts are only allowed to park in handicapped parking spaces if the driver or at least one passenger has a valid handicapped parking sticker.
(O) UTV’s or Golf Carts need to park in the downtown municipal parking lots when parking in the business district. There will be no UTV or Golf Cart parking on Main or Railroad Street from Schuyler to Vernon Street.
(P) The operator of a UTV or Golf Cart shall obey all ordinances of the Village of Lena and all provisions of the Illinois Vehicle Code, as amended from time to time.
(Q) The operator of a UTV that is being used to plow snow will need to have a flashing orange light and backup beeper.
(R) The parents of any operator who is a minor, who violates the provisions of this ordinance, shall be subject to the penalties imposed by this ordinance.
SECTION 13-114: REQUIRED EQUIPMENT

(K) Approved “slow moving vehicle” emblem attached to the rear (L) Yellow flashing light visible for at least 100 feet from rear of vehicle (if operated one half hour before sunrise or after sunset)
SECTION 13-115: PERMITS
(A) No person shall operate a UTV or Golf Cart without obtaining a permit from the Village of Lena as provided in this Section. Permits will be issued for each fiscal year May 1 to April 30. Annual cost shall be as provided in subsection (C).
(B) Permits shall be granted for a period of ownership of the UTV or Golf Cart by the person who received the permit and will remain valid as long as they continue to meet the requirements.
(C) The annual cost of a permit is $50.00 per UTV or Golf Cart. In the first year of permitting a newly permitted UTV or Golf Cart, a permit issued between May 1 and August 31 shall

be $50.00, if issued between September 1 and April 30, the permit fee will be $25.00. Thereafter, the annual permit fee shall be $50.00.
(D) UTV or Golf Cart owners must complete a permit application form supplied by the Village and contain the following information: Name, Address, Phone number, Make, Model, Serial number, Name of Insurance carrier and policy number.
(E) After completion of the application and payment of the permit fee, the applicant shall present the UTV or Golf Cart to the Chief of Police, or his designee, for an inspection to determine whether the UTV or Golf Cart may be operated on the Village streets. If the applicant and UTV or Golf Cart are qualified under the terms and conditions of this ordinance, a license MUST be displayed at all times per the applicant’s permit. The Village/Police Department shall issue a permit as visible proof of compliance, which shall be valid for the duration of the ownership of the UTV or Golf Cart by the person receiving the permit. The license will be displayed on the rear of the UTV or Golf Cart.
SECTION 13-116: ENFORCEMENT
(A) Any person found to be in violation of any provision of this Chapter, Article XIII, shall be fined $100.00 – $500.00.
Each day a continuing violation exists may be deemed a separate offense.
(B) The license of an operator of a UTV or Golf Cart issued pursuant to this ordinance may be suspended by the Chief of Police, or his designee, if 1) there is any material misrepresentation made by the applicant on the application or, 2) the required liability insurance is no longer in full force and effect or, 3) there is evidence that the license holder can no longer safely operate the UTV or Golf Cart or, 4) for any reason that he feels is appropriate to insure the safety and well-being of the citizens of the Village of Lena.
(C) The Chief of Police, or his designee, shall issue a notice of suspension of a license in writing and either hand deliver the notice to the license holder or send the notice by certified mail to the license holder at the address on the application. The suspension of a license shall be effective immediately after personal service, or on the third day after the post mark of the certified mail receipt.
(D) Upon investigation by the recommendation of the Village of Lena Police Department, the Village Board may suspend or revoke a permit granted hereunder upon a finding that there is evidence that the Permittee cannot safely operate a UTV or Golf Cart on Village streets or for any
reason that they feel is appropriate to insure the safety and well-being of the citizens of the Village of Lena.
(E) Repeat offenders may have the privileges revoked permanently by the Village of Lena Board.
